Legislative process to regulate medical laboratory assistants and medical laboratory technicians
The legislative process leading to the regulation of medical laboratory assistants and medical laboratory technicians is a multi-step process, involving the CMLTO, the Ontario Ministry of Health and Long-Term Care (MOHLTC), the Health Professionals Regulatory Advisory Council (HPRAC), and many other stakeholders.The basis for demonstrating the need for regulation of a new health profession is determined by HPRAC criteria and recommendation is made to the Minister of Health and Long-Term Care.


Laws and legislation governing MLTs
Ontario laws administered by the Ministry of Health and Long-Term Care (MOHLTC) set the legal framework for governing regulated health professions, yet regulatory Colleges, such CMLTO, are independent of the MOHLTC.

The role of the various Colleges in self-regulation, and their authority and powers, are set out in the Regulated Health Professions Act, 1991 (RHPA), the Health Professions Procedural Code, which is Schedule 2 to the RHPA.

Each profession also has its own statute, which spells out and defines the scope of practice and the controlled acts that are authorized to the profession. The MLT statute is the Medical Laboratory Technology Act, 1991 (MLTA). In addition, there are applicable regulations made under both the RHPA and the Medical Laboratory Technology Act, 1991.
