Consultations with stakeholders are a vital part of policy development and review within the health care sector. This process helps the College of Medical Laboratory Technologists of Ontario (CMLTO) ensure it meets its statutory mandate to protect the public. 

The CMLTO often works with other stakeholders to provide subject matter expertise and insight. During the past year, the CMLTO has initiated or responded to numerous consultations.

Revised CMLTO Consolidated By-Laws: Public Consultation and Public Information Session

The College of Medical Laboratory Technologists of Ontario (CMLTO) is inviting its Registrants, stakeholders, and the public to participate in a consultation on the new CMLTO By-Law.



The CMLTO Consolidated By-Laws came into effect on December 31, 1994 and underwent many amendments since then to ensure that they remained consistent with legislation. The current document served its purpose for 28 years.
The external and internal consultation and comprehensive review of the new CMLTO Consolidated By-Laws conducted in March 2022 revealed that:
  1. The current By-Laws had many challenges stemming from the incremental amendments made throughout the years, which made the document complicated and somewhat impaired the coherence of the document,
  2. The current By-Laws required very extensive and general revisions which were scattered throughout the document and could not be made through incremental amendments, and
  3. A fundamental rewrite of the By-Laws was required to address these challenges.
The CMLTO By-Law supplements the Regulated Health Professions Act, 1991 and the Medical Laboratory Technology Act, 1991, and guides how the College will be run and sets the ground rules for organizational policy and process.
Therefore, it is crucial that the new CMLTO By-Law, which is the revised and updated version of the current CMLTO Consolidated By-Laws:
  • Accurately reflects the direction of the College, matches its mission, goals of governance and operational needs and adapts to the changing environment,
  • Remains up-to-date and reflective of the current state of the College, and
  • Reflects accountability, transparency and effectiveness to foster excellence in service and inspires trust.
The new CMLTO By-Law has been developed pursuant to Section 94 (1) of the Health Professions Procedural Code, being Schedule 2 of the Regulated Health Professions Act, 1991.

The new CMLTO By-Law is intended to:
  • Continue to reflect the current legislation,
  • Align with the CMLTO Board Governance Model,
  • Match the actual/current organizational practices,
  • Reflect the organizational changes,
  • Align with the by-laws of other health regulatory colleges,
  • Be interpretable to give the Board of Directors the flexibility to choose a direction on different circumstances,
  • Be easier for the public and the Registrants to interpret and staff to administer, and address the foreseeable scenarios to avoid any possible loopholes.
The following reference documents have been taken into consideration in the fundamental rewrite process:
1.    Current Legislation,
2.    Ministry of Health – College Performance Management Framework (CPMF),
3.    By-Laws of 26 Health Regulatory Colleges, and
4.    CMLTO Governance Documents.

At its September meeting, the CMLTO Board of Directors approved the new CMLTO By-Law in principle, for circulation to Registrants for a minimum of sixty (60) days pursuant to Section 94 (2) of the Health Professions Procedural Code, being Schedule 2 of the Regulated Health Professions Act, 1991.
All feedback received as a result of this consultation prior to November 21, 2022 will be compiled and presented to the Board of Directors prior to its final deliberations. The new CMLTO By-Law will be presented to the Board of Directors for approval at its meeting on December 2, 2022.
